Now What? OSHA’s COVID-19 Vaccination and Testing ETS in the Courts

Hello FEAT Members-  

As you probably have heard, on November 4, the Occupational Safety and Health Administration (OSHA) published an emergency temporary standard (ETS) for employers with 100 or more employees to minimize the risk of COVID-19 transmission in the workplace. For most large employers, the ETS generally requires employees be vaccinated or undergo weekly testing and wear a mask to visit a workplace. At almost 500 pages long, there are many details to digest, communicate, and ultimately implement over the next two months. 

While a number of parties have challenged OSHA’s ETS in Circuit Courts around the country, it is likely that a final binding determination will not be made in these cases for weeks or even months. We are therefore preparing to implement the requirements as if they will take effect on January 4.
